These Terms of Use (“Terms”) govern your access to and use of promdftl.com (the “Site”), operated by Charles Street Co LLC, doing business as ProMD Health Ft. Lauderdale, a licensed medical clinic at 500 E Broward Blvd, Suite 122, Fort Lauderdale, FL 33394. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. No medical advice; no doctor-patient relationship
Everything on this Site — service descriptions, pricing, treatment information and any educational content — is general information, not medical advice. Using this Site, submitting a form, or contacting us through it does not create a doctor-patient or other clinical relationship. That relationship begins only after a consultation, intake and consent process at our clinic. Do not rely on this Site in place of a professional evaluation, and consult a qualified provider about your own health.
2. Services are provided by licensed medical professionals
Charles Street Co LLC d/b/a ProMD Health Ft. Lauderdale is a licensed medical clinic. The aesthetic and wellness services described here are performed by, or under the supervision of, licensed medical professionals, including Marissa Palermo, APRN. Not every service suits every person; eligibility is determined by a licensed provider at consultation.
3. No guarantee of results
Descriptions of expected outcomes, and any before-and-after imagery or testimonials on this Site, reflect individual experiences and are not a guarantee that anyone else will see similar results. Outcomes vary with anatomy, health history and adherence to post-treatment guidance. Where before-and-after photographs appear, they depict actual results of individual patients unless otherwise noted; no image is a promise or warranty of any other patient’s outcome.
4. Pricing
Prices listed on this Site are for general reference and may change without notice. Final pricing is confirmed at your consultation and varies with the treatment plan, the product and dosage used, and other clinical factors determined by your provider.
5. Statutory notice
As required by Florida law:
THE PATIENT AND ANY OTHER PERSON RESPONSIBLE FOR PAYMENT HAS A RIGHT TO REFUSE TO PAY, CANCEL PAYMENT, OR BE REIMBURSED FOR PAYMENT FOR ANY OTHER SERVICE, EXAMINATION, OR TREATMENT THAT IS PERFORMED AS A RESULT OF AND WITHIN 72 HOURS OF RESPONDING TO THE ADVERTISEMENT FOR THE FREE, DISCOUNTED FEE, OR REDUCED FEE SERVICE, EXAMINATION, OR TREATMENT.
6. Appointments, cancellations and no-shows
Scheduling is handled through our booking partner at bookpromdhealth.com. Cancellation, rescheduling and no-show policies, including any fees, are disclosed at booking and during intake, and are incorporated into these Terms by reference.
7. Promotions
Any sweepstakes, giveaway or promotion referenced on this Site, including the ProMD Bridal Scholarship, is governed by its own Official Rules, which control over these Terms in the event of a conflict. No purchase or payment of any kind is necessary to enter or win.
8. Intellectual property
The text, graphics, logos and photographs on this Site are owned by or licensed to Charles Street Co LLC d/b/a ProMD Health Ft. Lauderdale and protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. You may not copy, republish, distribute or create derivative works from this content for commercial purposes without our prior written consent.
9. Third-party links
This Site links to third-party sites, including our booking partner, our Instagram page and our Google Business Profile. We do not control and are not responsible for their content, privacy practices or terms; your use of those sites is governed by their own.
10. Disclaimer of warranties
THIS SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CHARLES STREET CO LLC D/B/A PROMD HEALTH FT. LAUDERDALE AND ITS OWNERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION DOES NOT APPLY TO LIABILITY FOR PERSONAL INJURY OR PROFESSIONAL NEGLIGENCE ARISING FROM ACTUAL MEDICAL TREATMENT, WHICH IS GOVERNED BY THE SEPARATE INFORMED CONSENT AND TREATMENT AGREEMENTS EXECUTED AT OUR CLINIC, NOT BY THESE WEBSITE TERMS.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of this Site shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
13. Accessibility
We aim to make this Site usable by everyone, including people with disabilities, and to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have difficulty accessing any part of this Site, please contact us so we can help and fix the problem.
14. Changes to these Terms
